Terms of Use

These Terms of Use ("Terms") govern your access to and use of the PlayHub Cloud website, dashboard, applications, software, and related services (collectively, the "Platform"). By accessing or using PlayHub Cloud, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Platform.

Acceptance of Terms

By creating an account, accessing, or using PlayHub Cloud, you confirm that you have the legal capacity to enter into these Terms and agree to comply with all applicable laws and regulations.

Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to use PlayHub Cloud. If you access the Platform on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.

Platform Services

PlayHub Cloud provides cloud-based software and related services for monitoring, managing, and analyzing entertainment and amusement equipment, together with any additional features made available through the Platform.

Features, functionality, and availability may change at any time without prior notice.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities performed through your account.

• Provide accurate and current information.
• Keep login credentials secure.
• Notify PlayHub Cloud immediately of any unauthorized account access.
• Remain responsible for all activity occurring under your account.

Permitted Use

You agree to use PlayHub Cloud only for lawful business purposes and in accordance with these Terms.

You agree not to:

• Violate applicable laws or regulations.
• Attempt unauthorized access to systems or accounts.
• Interfere with the operation or security of the Platform.
• Upload malicious code, malware, or harmful content.
• Reverse engineer, decompile, or copy the Platform except where permitted by law.
• Use PlayHub Cloud to infringe the rights of others.

Customer Data

You retain ownership of data that you upload to PlayHub Cloud. You grant PlayHub Cloud a limited license to process such data solely for providing, maintaining, securing, and improving the Platform.

You are solely responsible for ensuring that all uploaded data has been lawfully collected and that you have all necessary rights and permissions.

Intellectual Property

All software, technology, trademarks, content, graphics, interfaces, documentation, and other materials provided by PlayHub Cloud remain the exclusive property of PlayHub Cloud or its licensors.

These Terms do not transfer ownership of any intellectual property rights to you.

Subscriptions and Fees

Certain services may require payment of subscription or service fees.

• Applicable pricing will be presented before purchase.
• Fees are payable according to the selected subscription plan.
• Taxes may apply where required by law.

Refund Policy

Unless otherwise required by applicable law or expressly agreed in writing, subscription fees and service payments are non-refundable once the applicable billing period has begun.

Nothing in this section limits any consumer rights that cannot legally be excluded.

Availability

PlayHub Cloud aims to provide reliable service but does not guarantee uninterrupted, error-free, or continuous availability.

Maintenance, updates, technical issues, security events, or circumstances beyond reasonable control may temporarily affect access to the Platform.

Third-Party Services

The Platform may integrate with or provide access to third-party products or services.

PlayHub Cloud is not responsible for third-party websites, software, products, policies, or services.

Limitation of Liability

To the maximum extent permitted by applicable law, PlayHub Cloud shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, business interruption, loss of data, or loss of goodwill arising from the use of or inability to use the Platform.

PlayHub Cloud's total liability arising from these Terms shall not exceed the amount paid by you for the applicable services during the twelve (12) months immediately preceding the event giving rise to the claim.

Disclaimer of Warranties

PlayHub Cloud is provided on an "as available" and "as is" basis.

To the maximum extent permitted by law, PlayHub Cloud disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

Indemnification

You agree to indemnify and hold harmless PlayHub Cloud, its affiliates, employees, contractors, and service providers from claims, damages, liabilities, costs, and expenses arising from your use of the Platform, violation of these Terms, or infringement of any rights of another person.

Termination

PlayHub Cloud may suspend or terminate access to the Platform at any time where reasonably necessary, including for security reasons, suspected fraud, breach of these Terms, legal compliance, or operational requirements.

You may discontinue use of the Platform at any time.

Privacy

Your use of PlayHub Cloud is also governed by the Privacy Policy and Cookies Policy, which form part of these Terms.

Changes to the Terms

PlayHub Cloud may update these Terms from time to time. Updated Terms become effective upon publication unless otherwise stated.

Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which the operator of PlayHub Cloud is incorporated, without regard to conflict of law principles.
